Introduction
These Terms and Conditions govern the contractual relationship between [Your Name] (the “Artist”) and any individual or entity (the “Client”, the “Buyer”, the “Collector”) purchasing original artworks, prints, derivative products, or custom commissions through [website URL].
By placing an order, the Client expressly accepts these terms.
1. Purpose
These Terms define the sale conditions of original artworks, reproductions, derivative products, and custom commissions, specifying the rights and obligations of both parties as well as delivery and payment terms.
2. Products Offered
1. Original Artworks: unique watercolor pieces sold as-is.
2. Prints / Reproductions: digital reproductions or limited prints.
3. Derivative Products: objects incorporating the artwork (cards, posters, textiles, etc.).
4. Custom Commissions: tailored creations according to a brief agreed upon with the Client.
The Artist reserves the right to refuse any order deemed inappropriate or unfeasible.
3. Ordering
- Orders can be placed via the website, email, or other channels specified by the Artist.
- Custom commissions require an accepted quote before work begins.
- Clients must provide accurate and complete information.
4. Price and Payment
- Prices are listed in Euros (€) excluding VAT, in accordance with Article 293 B of the French General Tax Code. As a microbusiness/self-employed artist, the Artist is exempt from VAT and does not charge VAT on sales.
- Payment is due at the time of ordering unless stated otherwise.
- Accepted payment methods: credit card, bank transfer, PayPal, or as specified on the website.
- For commissions, a deposit of [e.g., 50%] is required before starting work.
5. Delivery
- Products are delivered to the Client’s specified address.
- Delivery times are indicative; the Artist is not liable for delays beyond their control.
- Delivery costs are borne by the Client unless otherwise stated.
- **International deliveries**: if you order from abroad, duties, taxes, or similar fees may apply to your shipment. These fees are the Client’s responsibility and cannot be reimbursed by the Artist.
6. Right of Withdrawal
According to French Consumer Code (L221-18 et seq.):
- Original artworks and standard products (prints, derivative products): Clients have 14 days from receipt to exercise their withdrawal right. Return costs are borne by the Client.
- Custom orders: withdrawal rights do not apply for personalized goods.
7. Intellectual Property
- All artworks remain the exclusive property of the Artist, including after sale, unless rights are explicitly transferred.
- Any reproduction, distribution, or exploitation without written permission is prohibited.
8. Liability
- The Artist is not liable for indirect damages related to the use of products.
- Liability is limited to proven faults or defects in delivered products.
9. Governing Law and Jurisdiction
- French law applies.
- Any dispute will be submitted to the competent courts of the Artist’s residence.
10. Acceptance
Placing an order implies full and unconditional acceptance of these Terms.
